License Agreement

PLEASE READ THE FOLLOWING BEFORE USING OUR SOFTWARE. BY USING ANY OF OUR SOFTWARE YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS.

1. TITLE

Skypanther Studios remains the owner of all right, title, logo, content and interest in the software and related explanatory written materials. This software contains code published by the PEAR project (pear.php.net) of the PHP Group. That code is licensed under the PHP, LGPL, or other licenses. Per that license, we state: "This product includes PHP, freely available from http://www.php.net/" Further, Skypanther Studios makes no copyright or ownership claim of that software.

2. USE OF SOFTWARE

By purchasing a license for this software you may have an unlimited number of instances of the software for a single domain. If you plan on running or associating this software under multiple domains then you must purchase additional licenses for each domain.

3. ARCHIVAL OR BACKUP COPIES

You may copy the software for backup and archival purposes, provided that the original and each copy is kept in your possession and that your installation and use of the software does not exceed that allowed in the "Use of Software" section above.

4. THINGS YOU MAY NOT DO

Things you may not do:

• Copy the software except to make archival or backup copies as covered above
• Remove or modify any product or company copyright notices and "Powered by" statements
• Install the software on a single computer and use it to backup databases from multiple domains (you need a license per domain to be backed up)
• Install copies of this software to multiple web sites, unless each of those sites serves the same, single Internet domain.

5. MODIFYING THE SOFTWARE

Users may change or modify the software to suit their needs, at their own risk, for their own use. As covered in the "Things You May Not Do" section above, you may not remove or modify any copyright or "Powered by" stsatements throughout the software. Skypanther Studios assumes no responsibility and provides no support for problems resulting from modifying the source code.

6. CONFIDENTIALITY

The software contains trade secrets and proprietary know-how that belong to us and it is being made available to you in strict confidence. Any use or disclosure of the software, or of its algorithms, protocols or interfaces, other than in strict accordance with this license agreement, may be actionable as a violation of our trade secret rights.

6. TERM AND TERMINATION

This license agreement takes effect upon your use of the software and remains effective until terminated. You may terminate it at any time by destroying all copies of the Software and Documentation in your possession. It will also automatically terminate if you fail to comply with any term or condition of this license agreement. You agree on termination of this license to destroy all copies of the Software and Documentation in your possession. Failure to do so may result in legal actions for Software Piracy.

Warranty Disclaimer

THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.

NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE. FAILURE TO INSTALL THE SOFTWARE IS NOT A VALID REASON FOR REQUESTING A REFUND OF THE PURCHASE PRICE, NOR IS FAILURE TO ENSURE THAT THE SOFTWARE MEETS THE SYSTEM REQUIREMENTS.

• THE USER ASSUMES THE ENTIRE RISK OF USING THE SOFTWARE.
• THE USER ASSUMES THE ENTIRE RESPONSIBILITY FOR ENSURING THAT BACKED UP FILES CAN BE RESTORED.
• THE USER ASSUMES THE ENTIRE RESPONSIBLITY FOR SAFEGUARDING THE SECURITY OF DATA BACKED UP BY THE PROGRAM.

Skypanther Studios reserves the right to change or update any part of this license agreement at any time, at its sole discretion, without notice, and compliance with such revisions is a prerequisite to your continued right to use any of our software.
